From proposal to enforceable rule
A consultation, legislative proposal, adopted rule and enforcement action are different stages of regulation. Coverage is easier to evaluate when the jurisdiction, responsible authority, affected activity and effective date are explicit. The EU's MiCA framework addresses crypto-assets and service providers within its scope; the official rulebook is a better starting point than assuming that every crypto product is treated identically.
Questions to ask of each report
- What has actually changed: a proposal, final text, implementation guidance or a court decision?
- Which activities and jurisdictions are covered, and does a transition period apply?
